The new Law 5239/2025, titled “Fair Work for All”, introduces significant changes to the regulatory framework governing Occupational Health and Safety (OHS). Its aim is to modernize the system, strengthen prevention, protect mental health and leverage digital tools for more effective monitoring of working conditions.

Key Changes

The new framework updates the provisions of the Labour Code related to Occupational Health and Safety, introducing key reforms in the following areas:

🔹 Enhanced role of Employee Health & Safety Committees (EHSC), including the establishment of extraordinary meetings.

🔹 Updated classification of enterprises by sector and risk category, along with a revised list of approved professional qualifications eligible to serve as Safety Technicians.

🔹 Specific reference to working conditions for employees with disabilities or chronic illnesses, and the employer’s obligation to implement appropriate prevention and protection measures.

🔹 Rationalization of the duties and responsibilities of Safety Technicians and Occupational Physicians.

🔹 New qualifications and specialization requirements for Safety Technicians and Occupational Physicians.

🔹 Digitalization (electronic recordkeeping) of the Observation Book, integrated into the Labour Inspectorate’s Unified Information System (OPS-SEPE).

🔹 Revised procedures for reporting occupational accidents and diseases.

🔹 Mandatory training in CPR and the Heimlich maneuver.

🔹 Establishment of a minimum working time requirement for Safety Coordinators on construction sites.
